#1 Subject
Subject to these Terms of Trade are all operations of Trabant Berlin, in particular the rental of historical vehicles and services in connection with these cars.

#2 Rates

For any particular operation there applies the rent given in the rental contract. Generally the rate includes the useage of the car for a certain time and kilometres to be driven. Other services (like chauffeur services) may be calculated extra and be given in the contract as a package price. Normally the rate is to be payed at the begin of the ride; but latest seven days after conclusion of the rent.

#3 Fuel
Fuel is not included in the rental rate. Normally the car will be handed over with a completely filled petrol tank, unless stated otherwise in the contract. Used fuel has to be refilled by the user or is charged at the conclusion of the fare. The user is to stick to the refilling protocolls pricisely. The gasoline fee is 0,18 EUR per km. E10 Gasoline is not to be used.

#4 Check-out
After the rental contract has been concluded the car will be handed over to the costumer by a TrabantBerlin employee. All drivers get a briefing concerning  the technical details and the use of the car. No one is allowed to drive the car without this briefing.  The employee is also checking the condition of the driver and his/her license. The condition of the vehicle is being noted down in a protocoll, that both parties sign. The car is not handed over if the designated driver is (by sight) supposingly unable to drive the car safely. This applies especially for persons under the influence of alcohol, drugs or other (current or steady), physical or psychological unabilities concerning street traffic. The determination whether or not anindividual is able to conduct the vihicles lies in the responsibility of the Trabant Berlin representative, only. In this case an alternative appointment can be made or the contract may be cancelled. #10 applies.

#5 Rental time / Check-In
The rental time is given in the contract. It is binding - so is the check-in place - and can only be shortened or prolonged in special cases with the concent of both parties.  Any costs caused by the delay have to be covered by the client. Contract creation, paperwork, briefing and check-in are part of the rental time.

Trabant Berlin may claim damages after check-in if they were not obvious in normal sight and at least most likely to be caused by the client.

#6 Damages

The client is obligated to preserve the vehicle to the best of his ability. He has to refrain from and prevent other from damaging it at any time. If the client is guilty of a damage trough accident he has the risk for damages on the car up to EUR 1500.- For all damages that occur outside an accident (handling mistakes, vandalism, carelessness, damage with unclear cause) the client is accountable up to EUR 1500.- All damages will be listed in the check-in protocoll.  It is prerogative of Trabant Berlin to hire an expert for naming the exact amount of damage at the expense of the client. If the client is clearly guilty and accountable for damages done on the car, he is as well accountable for all follow up costs (towing, canceled contracts etc.)

# 7 Limitations
Trabant Berlin vehicles are to be used for driving on public roads or compareable private property, only. It is espcially pohibited to:
a) take the car abroad (other than Germany)
b) to participate in any motorsport events with the car
c) to use the car for other things than driving
d) to participate in driving trainings
e) to participate in technical or scientifical tests with the car
f) to rerent the car
g) to use the car for commercial transport
h) to produce any non private footage, pictures, films or other documentation of the car, unless approved by the oprator before
i) to rerent the car
j) to use the car to commit offences or crimes (including braching of traffic and parking regulations
k) to use the car for the transport of dangerous goods
l) to use the car beyond it's technical limits
m) to take any technical change on the car
n) to transport heavy or oversized good with the car

# 8 Obligations in case of damage
Should and accident or another damage or technical defect occur the prevention of general danger and the life and health of all people at the scene is the absolute top priority. In case of an accident, a damage, a technical failure, a crash with wildlife Trabant Berlin an the police has to be informend in an instance.  For every damage or accident the client has the obligation to report the comprehensive circumstances to Trabant Berlin. The report has to feature a detailed description of the event, a sketch of the scene, the names and leads of all persons involved, the witnesses, the license plate numbers of all vehicles, the names,ranks and registration numbers of all police officers and other officials at the scene. Furthermore a copy of all official records or documents the clients is in hold of. Trabant Berlin is the only one to decide about towing, repairing or relocating the car and takes care about all insurance questions.

# 9 Technical defects
Technical defects - in respect to the special characteristics of the cars, may be regarded as extraordinary circumstance. Trabant Berlin has the right to provide another vehicle, roughly matching the characteristics of the one with the failure or to offer another rental slot. Alternatively a refund can be provided, if Trabant Berlin fails to present an appropiate vehicle on this alternative slot. If this slot is impossible for the client, the agreement or the booking may be evoked. Should such defect occur during driving the client has to secure the scene and inform Trabant Berlin immediately. Trabant Berlin is the only one to decide towing the car or take other action. The client is not allowed to give any order to any workshop, repair- or towing company. The rental rate may be refunded, if Trabant Berlin fails to present an alternative rental slot.

#10 Deposit

At check-out the client is to provide a deposit of EUR 100.- for the vehicle. The deposit is to be paid cash. If there are damages on the car at check-in Trabant Berlin will keep the deposit until the price for repairs is determend. Expenses and repairs may be covered by the deposit sum. If there are no damages the deposit is handed back in cash at the end of the rental time.

#11 Cancellation fees

Should a company, a juristic person or a public special treasury by own decision or own dicision cancel a rent less than 14 days in advance this will result in a cencellation fee of 30 per cent of the rent. Should this cancellation be made on the day of rent the cancellation fee is 50 per cent of the rent. Cosumers are given the opportunity to prove that there was no cancellation loss sustained or the loss would be much less worth than the fee demanded.

#12 Offences and Crimes
If the client or any of the designated drivers uses the vehicle to break traffic regulations, commit offences or crimes the driver is to named to Trabant Berlin. The offender will be named to thr proper authorities.

#13 Legal stand
  Legal stand is Berlin. All contradicting client's Terms of Trade will be without subject to all operations of Trabant Berlin.

#14Salvatoric Clause

If one of the clauses in these terms of trade will be unlawful, unfulfillable or odd in any other sense, this dies not effect any other clause. all parties will be obligated to put in a cluase, that would match the sense of the odd clause best.
